Being placed under arrest for charges of DUI is a frightening and confusing experience. You will have questions about your future. You may ask yourself how this arrest will affect your employment or relationships with family and friends. The stress of facing a criminal case can be detrimental to you and your loved ones.

Field Sobriety Testing

After initiating a traffic stop, if a defendant looks to be in good health, the officer will request submission of field sobriety testing. These are physical exercises designed to pinpoint individuals who are under the influence of alcohol and/or drugs. An officer may ask a driver to walk a straight line, with a specific number of steps and instructions; or watch the end of a flashlight to determine the eyes’ reflex response time. Officers use the results of these tests to determine a driver’s sobriety and whether or not further blood alcohol testing is necessary. These tests are administered by officers and human nature could interpret results inaccurately. I will request the police video of the field sobriety test and dispute the officer’s opinion on your behalf.  If the police fail to possess valuable video evidence, this is a plus to your defense. I will advise the prosecution of the holes in their case and establish reasonable doubt in Court.

Blood Alcohol Testing

Officers use breath, urine or blood testing to determine the level of alcohol in a driver’s system. This is can be a fairly accurate method to ascertain whether the driver is over the Florida legal limit of .08, but it is not fool proof. Results could be skewed if the test administrator is not properly certified to perform the test or if other issues could have jeopardized the accuracy. I will investigate whether the equipment is regularly maintained and if it is in good working order. I will aggressively challenge the toxicological evidence against you to establish your innocence.

Defendant Rights

Suspects have rights, and often times arresting officers do not abide by those constitutional provisions. As your defense attorney, I will review the arrest record to ensure the officer followed all proper procedures. The charges against you may be dropped if the police did not recite your Miranda Rights or posses no just cause to initiate a stop. As your defense attorney, I will bring to focus any unjust actions by the arresting officer that may have violated your rights granted to you by the U.S. Constitution.

Implied Consent Law

A suspect also has the right to refuse field sobriety testing and or alcohol testing. However, if you do decide to refuse testing, but there are consequences. The Department of Highway Safety and Motor Vehicles will automatically suspend your license for a period of six months. The State considers driving to be a combination of privilege and responsibility. Drivers must agree to the Implied Consent Law, or a promise to submit to alcohol testing, prior to being granted a Florida driver’s license. A defendant has only 10 days to request an administrative review hearing and challenge the suspension of your license. You must retain a qualified attorney prior to this deadline.

Formal Administrative Review Hearing

I will request a formal administrative review hearing on your behalf. This hearing is held before an officer of the Department of Highway Safety and Motor Vehicles and is unrelated to the pending criminal case. I will subpoena witnesses and arresting officers to retract statement inconsistencies. I will effectively address varying testimony in an effort to reestablish your driving privileges.  

Charge of DUI Overview

 All DUI charges are not created equal. Charges range from a misdemeanor first offense of driving under the influence to felony manslaughter stemming from a DUI with injury. It is common place that additional criminal charges may also be filed in conjunction to a DUI. These additional charges will escalate the status of the offense and significantly increase the degree of punishment. You need an attorney qualified to handle your tough case and avoid conviction.

Things You Need to Know About Administrative Review Hearings

You only have 10 days from the date of your DUI arrest to request a formal administrative review hearing regarding the retention of your driving privileges (keeping your drivers license). Failure to request a hearing will result in an automatic suspension of your drivers license.

Failure to request a formal administrative review hearing will result in an automatic six month suspension of your Florida drivers license for failing a breathalyzer test, and a one year suspension of your Florida drivers license for refusing to submit to a test.

In addition, any evidence obtained at the administrative review hearing may be used against you at your criminal DUI trial. Likewise, favorable evidence can be used in your favor.

Rebecca Sonalia, Esq.

After completing her B.A. in Political Science from the University of Michigan, Attorney Rebecca Sonalia received her Juris Doctor from Michigan State University College of Law, graduating cum laude.  She is licensed to practice law in the State of Florida and the State of Michigan.

Mr. Minardi received his Juris Doctorate degree in 2002 from Nova Southwestern University, Shepard Broad Law Center. Jeff Quisenberry

Florida Criminal Defense Attorney Jeff R. Quisenberry has been practicing law for over 21 years, and has tried over 100 jury trials, including over fifteen homicide cases and over fifty life and capital felonies. After working as a certified legal intern for the Miami-Dade County State Attorney's Office, Mr. Davidow started his own criminal defense and general civil litigation law firm. Mr. Davidow now comes to Musca Law after successfully operating his private practice.

Throughout the course of Mr. Davidow's life he has gained a wealth of knowledge and experience. Mr. Davidow has lived in Long Branch, New Jersey; Blacksburg, Virginia; Miami, Florida; Nashville, Tennessee; Seville, Spain; and Tokyo, Japan. He is fluent in Spanish, and he also reads and speaks some Japanese. Martin Cordell , Esq.

Musca Law is proud to welcome Martin Cordell to the firm and looks forward to utilizing his many talents.  Mr. Cordell boasts over three decades of experience representing clients in all types of personal injury cases, with an emphasis on claims resulting from motor vehicle accidents.  These matters have enriched him with extensive litigation and jury trial experience.  Mr. Cordell also is a veteran in handling criminal cases, misdemeanor and felony, as well real estate, corporate, and appellate work.  One of his many highlights includes winning an appeal in a significant real estate case before Florida’s 5th District Court of Appeal, no small feat.

Mr. Cordell is a graduate of the City College of New York where he graduated cum laude with a Bachelors of Arts.  He then continued on to Stetson University of College of Law and received his Juris Doctor in 1975 and was admitted to the practice of law that same year.  After a few years of handling insurance cases, Mr. Cordell proceeded to strike out on his own.  He successfully ran his own law firm for over twenty years, winning many accolades, proving that he’s an accomplished attorney. 

In addition to being a member of the Florida Bar, Mr. Cordell is admitted to practice before the United States District Court for the Middle District of Florida, and the United States Courts of Appeals for the 5th and 11th Circuits.  He also is an active life member of Phi Delta Phi International Legal Fraternity.  Of even greater prestige is his status as a Florida Civil Law Notary .  These notaries must pass a specialized examination in international law and are commissioned by the Secretary of State to authenticate documents used in international transactions.  There are currently fewer than 100 Florida Civil Law Notaries in the state of Florida.  It is this sort of commitment to excellence that will serve the clients of Musca Law well. 

Harry Lee Greenway, Esq.

Musca Law Firm is honored to have a United States military veteran as a part of its legal team, Harry Lee Greenway.  He rose to the rank of Major in the Civil Air Patrol and served in many roles including: Florida Wing Inspector General, Florida Wing Assistant Legal Officer, Mission Search and Rescue Pilot, Squadron Commander, Group Legal Officer, Board of Directors, and President, Vice-President, and Treasurer of the Coordinated Transportation System.  The courage and dedication displayed in taking on the challenge of serving is reflected in the way that he represents our clients.

In addition to proudly serving our nation, Mr. Greenway has been a strong advocate for the mentally challenged.  Prior to becoming an attorney, he was employed in administrative, treatment, and supervisory positions related to the evaluation and treatment of mentally ill criminal defendants who were involuntarily committed.  While employed in this role, he served on the Patient’s Rights Committee and as Chairperson of the Equal Employment Opportunity/Affirmative Action Committee.  It is this sensitive devotion to a vulnerable population that displays his compassion and will ensure that he takes the time to communicate with clients and defend their rights.          

While working as an advocate for the mentally ill, he also found the time to graduate from the University of Florida with a Bachelors of Arts.  Already accomplished, he decided to endeavor into the practice of law and received his Juris Doctor,also from the University of Florida, and graduated in 1987.  During law school, his ambitious nature continued to flourish and he became a research assistant, focusing on the treatment and disposition of mentally ill criminal defendants.  Other honors he received include being a member of Phi Delta Phi Legal Fraternity and the John Marshall Bar Association.

After being admitted to the Florida Bar in 1988, Mr. Greenway’s legal career took flight.  He has distinguished himself by serving as a Florida State Attorney, Florida Public Defender, as well as being a private attorney.  Each of these roles being served more than once!  With this vast work experience, all sides of a case will be thoroughly known and vetted, and the best course of action under the circumstances will always be taken.  This ensures not only the best results, but in a cost efficient manner.

Lourdes Gonzalez

A self-professed lover of the area of criminal law, Lourdes Gonzalez is Musca Law Firm’s resident multilingual attorney.   Fluent in English, Spanish, and French, she brings an unparalleled level of communication to our clients that are not versed in the English language.  As the inability to discuss a case is just another hurdle in the already uncomfortable situation of facing criminal charges, her language skills offer a comfort to our non-English speaking clients.

Mrs. Gonzalez has practiced in the field of criminal law for twenty years, often obtaining dismissal of charges or victorious trial adjudications.  Since 1990, she has successfully operated her own personal practice, in addition to serving as a Florida public defender with a significant caseload of over 250 matters.  Her practice includes many cases before the federal courts of Florida.  She has also proved her legal acumen by serving as editor for legal encyclopedias, as well having several articles published.

Throughout her legal career, Mrs. Gonzalez has garnered experience in many different areas of the law.  During law school, she worked at the Alternative Dispute Resolution Center and assisted professors in publishing materials concerning estate planning, business development, and family law.  Post law school, she has devoted herself to working for the benefit of dependent and delinquent children, which provided an opportunity to practice before appellate courts.  Further, she founded and operated a jury consultation company, giving an excellent working knowledge of how to select the right jury, should a case proceed to trial. 

When not busy with the practice of law, Mrs. Gonzalez is a family orientated wife and an active participant in her community.  She has served as the president of a PTO group committed to propelling gifted students to even further heights.  Not satisfied with this accomplishment, she has moved on to president of another PTO group that develops fundraising projects, organizes and hosts school functions, and coordinates with teachers to improve the educational system.

If my driver’s license was suspended for DUI, can I apply for a hardship license?
Whether or not you are able to apply for a hardship license, as well as when you are able to apply, will depend upon your particular

What is a federal crime?

A federal crime, or federal offense, is an action which is illegal under federal statutes. Federal crimes also include those criminal offenses committed on federal property and crimes committed which involved crossed state lines or national borders. Some common examples of federal crimes include government fraud, bank robbery and kidnapping.

What is the difference between a felony and a misdemeanor?

Felonies and misdemeanors are differentiated based upon the potential penalties that the criminal offenses may carry. A misdemeanor is an offense which is punishable by up to 1 year in a county correctional facility. A felony is an offense which is punishable by death or imprisonment in a state penitentiary (state correctional facility) for a minimum of 1 year. Some crimes may be charged as a felony or a misdemeanor, depending upon the circumstances of the case. These are referred to as “wobblers.”

What is a white collar crime?

A white collar crime is a criminal offense which is most often a non-violent theft or fraud crime committed by an individual in a business or political environment, usually in a position of power or trust. Some common examples of white collar crimes include: fraud, embezzlement and identity theft.

Are juvenile crimes handled differently than adult crimes?

Yes. The Florida juvenile court system follows its own set of rules and procedures, and a juvenile faces different types of penalties than an adult. It is for these reasons that a defense attorney must be knowledgeable and experienced specifically with the juvenile court system and
juvenile crimes in order to provide effective representation to a minor who is facing criminal charges.

How can a defense lawyer help me?

A defense lawyer can help initially by answering any questions you may have and by reviewing your particular situation. It is impossible to say whether you need legal representation and what you are up against without reviewing your case and charges, and an experienced lawyer can do this. It is wise to consult an attorney if you have been contacted by local law enforcement or by a federal agency for questioning in regards to a criminal offense. It is important to find out whether you are a suspect in the investigation; if you are, it is essential to have an attorney at your side. While you may want to do whatever you can to cooperate with law enforcement, doing so without legal counsel may result in law enforcement overstepping their bounds and violating your rights, or you unintentionally incriminating yourself.
